Terms of service

These are the terms you buy under and use our website under. We have tried to write them in plain language. Where the law gives you more than these terms do, the law wins.

By using anaarandco.com or placing an order, you agree to these terms and to our privacy policy. Please read them before you order.

1. Who we are

anaar atelier, trading as anaar & co., Amsterdam, Netherlands.
KvK 42174754 · BTW NL005557408B93
Email anaarandco26@gmail.com · Instagram @shop.anaarandco
Our full contact details are on our contact information page.

In these terms, "we", "us" and "our" mean anaar & co., and "you" means the person using our website or buying from us. Our online shop runs on Shopify, but when you buy, your contract is with us.

2. What these terms cover, and what overrides them

These terms apply when you use anaarandco.com and when you buy from it.

If you are buying as a consumer, Dutch mandatory consumer law applies to your purchase and takes precedence over anything in these terms. Nothing here removes or reduces a right you have under that law. If a clause here conflicts with a right you have, the clause does not apply to that extent, and the rest of these terms still stand.

3. Using our website and your account

To place an order you must be at least 18, or have the permission of a parent or guardian.

When you order, we ask for details such as your name, email address, delivery address and payment information. Please make sure they are correct and up to date, as we rely on them to process and deliver your order.

If you create an account, keep your login details private. You are responsible for activity on your account unless it happens without your fault, and you cannot transfer your account to someone else. If you think someone else has used your account, email us straight away.

4. Our products

We work hard to show our pieces accurately. Colours on screen depend on your device and its settings, so a colour may look slightly different in person. This alone does not make a piece faulty, but if what arrives is clearly different from what was shown and described, your rights under sections 9 and 10 apply.

We may change product descriptions, stop selling a product, or limit the quantity one person can buy. This does not affect orders we have already confirmed.

5. Prices

All prices are in euro and include VAT.

Delivery is charged separately unless stated otherwise, and the cost is shown at checkout before you pay. See shipping and delivery.

Prices and promotions can change, but the price you pay is the one shown when you place your order, as set out in your order confirmation. Promotions and discount codes may have their own conditions, which we state with the offer; where they differ from these terms, the promotion's conditions apply to that promotion.

We do our best to keep prices and product details accurate. If we find an obvious pricing error after you order, we will contact you before dispatching and you can confirm at the correct price or cancel for a full refund.

6. How the contract is formed

Adding something to your basket is not an order, and our product pages are an invitation to order, not an offer.

Your order is an offer to buy. The contract is formed when we send you an order confirmation. If we cannot fulfil the order — because a piece has sold out, or we cannot deliver to your address — we will tell you and refund you in full.

Because we work in small runs, a piece occasionally sells out between your order and our confirmation. If that happens, you are not charged.

We may also decline an order before confirming it if we have reasonable grounds, for example suspected fraud or orders clearly placed for resale. If we decline, we will tell you and refund anything you have paid.

Our products are sold for personal use, not for commercial resale.

7. Payment

We accept iDEAL, Visa, Mastercard, Maestro, American Express, UnionPay, Apple Pay, Google Pay, Shop Pay, PayPal, Klarna, Bancontact and MobilePay. The options available to you depend on your country and are shown at checkout.

Payment is taken at checkout. Card details are handled by our payment provider and are not stored by us. You confirm that you are authorised to use the payment method you choose.

8. Delivery

We deliver to the countries shown at checkout.

Unless we agree otherwise with you, we will deliver within 30 days of the day the contract is formed. Delivery times shown on our site are estimates.

If we miss that, you can ask us to deliver within an additional period appropriate to the circumstances. If we miss that too, you can cancel and we will refund everything you have paid without delay.

Where delivery by a specific date was essential and you made that clear to us, or it was obvious from the circumstances, you can cancel straight away.

Risk passes to you when you, or someone you nominate, takes physical possession of the goods. Until then the parcel is our responsibility.

Orders delivered outside the EU may be subject to import duties and taxes, which are set by the destination country. See shipping and delivery.

9. Your right to withdraw

You have a statutory right to withdraw from your order within 14 days of receiving it, without giving a reason.

This right, how to use it, what condition goods need to be in, who pays return postage, and how the delivery charge is refunded are all set out in full on our refunds and exchanges page and our right of withdrawal page. Those pages form part of these terms.

10. Conformity and the statutory guarantee

We must deliver goods that match their description, are of the quality you can reasonably expect, and are fit for the purpose they are normally used for.

If they are not, you have rights under Dutch law — usually repair or replacement first, and a price reduction or refund where repair or replacement is not possible, would take too long, or would cause you significant inconvenience.

This is a legal entitlement. It is not a warranty we are choosing to give, it has no fee, and it is not limited to a fixed number of months in the way a commercial guarantee would be. How long you can rely on it depends on what you could reasonably expect from the item.

To use it, email anaarandco26@gmail.com with your order number and a description of the problem, with photographs if that helps.

11. Hand printing, and what it means for what you receive

Our pieces are hand block printed and finished individually in Jaipur. That process produces small variations between pieces: an impression that landed a little deeper, two colours meeting slightly differently, a placement that shifts by a fraction.

These variations are a characteristic of the product, and we describe them on the product page before you buy. They form part of the description you are agreeing to, so a piece showing them still matches its description.

This is not a disclaimer of faults. It does not cover damage, a defect, poor construction, a fault in the cloth, or an item that is not what was described. Your rights under section 10 apply in full to any of those.

If you are unsure whether what you have received is a variation or a fault, send us a photograph and we will tell you honestly.

12. Intellectual property

Everything on our website — including our name, logo, prints and designs, photographs, text, graphics and the way they are arranged — belongs to us or to the people who have licensed it to us, and is protected by copyright, trademark and other intellectual property laws.

You may view and use our website for your own personal, non-commercial use. You may not copy, reproduce, republish, sell or otherwise use any of its content, prints or designs, or use our name or logo, without our written permission. Sharing a link to our site or a product on social media is of course welcome.

13. Reviews and feedback

If you send us a review, photograph, suggestion or other feedback, you allow us to use, reproduce and publish it, free of charge, to run and promote our shop — for example by showing a review on a product page. Where we use your photograph or name, we will credit you or ask you first where appropriate.

Please make sure anything you send is honest, is your own, does not infringe anyone else's rights, and is not unlawful, offensive or misleading. We may decline to publish, or remove, feedback that does not meet these standards. If you received anything in return for a review, please say so in the review.

14. Using our website fairly

You may use our website for lawful purposes only. You may not:

  • use it for anything unlawful, fraudulent or harmful, or to harass or abuse anyone, including our team;
  • infringe our intellectual property or anyone else's;
  • upload viruses or malicious code, or try to interfere with or get around the security of the site;
  • scrape, copy or extract content or data from the site in bulk, including with bots, crawlers or AI tools;
  • send spam or unsolicited promotional material, or impersonate another person.

Automated software, including AI agents, that accesses our site on someone's behalf must identify itself as automated, may not disguise itself as a human or get around measures such as CAPTCHAs, and must stop if we ask it to. We may limit or block automated access.

15. Third-party tools and links

Our website may contain links to other websites, or tools provided by other companies, such as payment services, delivery tracking or social media. We do not control them and are not responsible for their content or how they work; their own terms and privacy policies apply when you use them.

This does not affect our responsibility for your order, or our liability for loss we cause.

16. Our relationship with Shopify

Our shop is powered by Shopify, which provides the technology that lets us sell to you. Any purchase you make in our shop is made directly with anaar & co., not with Shopify. Shopify is not responsible for any aspect of your purchase, including injury, damage or loss resulting from products you buy from us, and you release Shopify and its affiliates from claims relating to your purchases from us. This does not affect any of your rights against us.

17. Privacy

We handle your personal data as described in our privacy policy, and our use of cookies is explained in our cookie policy.

Because our shop runs on Shopify, Shopify processes some personal data to provide the shop to you, and information you submit is shared with Shopify and with service providers who help us run the shop, some of whom may be outside the country where you live. Our privacy policy explains this in more detail, and Shopify's own privacy policy is available on its website.

18. Our liability

We are liable to you for loss you suffer as a result of us breaking these terms or failing to use reasonable care, where that loss was a foreseeable result of what we did.

We do not exclude or limit our liability where the law does not allow it. That includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, under the Dutch rules on product liability, and for any of your rights as a consumer under mandatory Dutch law.

We are not liable for loss that was not foreseeable, or for business losses — we sell to consumers, and these terms do not cover use of our products for a business purpose.

We aim to keep our website available and accurate, but we cannot promise that it will always be uninterrupted or free of errors. General information on the site, such as styling ideas or care tips, is for information only.

19. Suspending access

If you seriously or repeatedly break these terms, we may suspend or close your account or block your access to our website. This does not affect orders we have already confirmed, any money we owe you, or your rights as a consumer.

20. Complaints

If something has gone wrong, email anaarandco26@gmail.com with your order number. We aim to acknowledge it within 3–4 working days and to give you a proper answer within 14 working days.

If we cannot resolve it between us, you can take the matter to court. As a consumer you can bring a claim before the competent court in the Netherlands or in the country where you live, and the mandatory consumer protections of that country continue to apply to you.

21. Governing law

Dutch law applies to these terms and to any contract made under them.

If you are a consumer, you keep the protection of the mandatory law of the country you live in, and you can bring proceedings in the courts there.

22. General

Severability. If a court decides that part of these terms is invalid or unenforceable, the rest of these terms still apply.

No waiver. If we do not enforce a right straight away, we can still enforce it later.

Entire agreement. These terms, together with the policies they refer to and your order confirmation, are the whole agreement between you and us about your use of our website and your purchase.

Transfer. You may not transfer your rights under these terms to someone else without our agreement. We may transfer our rights and obligations to another business, for example if our shop is sold, but only if this does not reduce your rights; we will tell you if it happens.

Headings. Headings are for convenience only and do not change the meaning of these terms.

23. Changes

We may update these terms, for example to reflect changes in the law or in how we work. The latest version is always on this page, and we will tell you about significant changes where the law requires it.

The version that applies to your order is the one live when you placed it.
